Other Similar Incidents

An Other Similar Incidents report is a compiled record of prior incidents — accidents, injuries, complaints, or claims — that share meaningful characteristics with the incident at the center of your case: same product, same defect, same location, same corporate conduct, or same pattern of negligence. Rather than treating your client's injury as an isolated event, an OSI report places it in context, showing whether the defendant had encountered this exact problem before.

Why it's helpful

OSI evidence goes directly to two things that can make or break a case:

  • Notice/Foreseeability — If a company knew (or should have known) about a hazard because it had happened before, that undercuts any argument that the incident was a freak accident or unforeseeable. It's often the difference between ordinary negligence and a case that supports punitive damages.

  • Pattern and Corporate Knowledge — A single incident can be dismissed as bad luck. Ten similar incidents in the years before your client's injury tells a very different story — one of a company that had the information needed to fix the problem and didn't.

OSI reports are built from a mix of sources: court records and prior lawsuits, regulatory complaints and recall databases.

I.E. 

Background and Objective

We understand that the client suffered permanent third-degree burns after a hot beverage from Redacted spilled due to an inadequately secured lid. The incident resulted in severe injuries to her thighs, groin, and genital area. The primary objective of this investigation is to identify prior incidents in which customers have sustained burns or other injuries due to a hot beverage spill from Redacted, resulting from a failure to secure the lid.

Scope of Work

We propose a comprehensive investigation spanning the past 10 years, including a thorough review of legal filings, news media, and other relevant sources, including social media and message boards, to identify similar incidents. This will include targeted searches of court records, with a specific concentration on incidents in Southern California, but will be expanded nationally. Following the investigation, we will provide a written report of our findings, including an analysis of any identified incidents to determine if there are patterns of conduct or systemic issues related to Redacted’ operational practices concerning the security of hot beverage lids.
